Online Design Consultation – Terms & Conditions

DAR ALHARER ALABYAD | White Silk Fashion House

These Terms and Conditions govern the private online design consultation service provided by Tarvi Collective, the company operating DAR ALHARER ALABYAD (the “House”).

By submitting a consultation booking request, the client acknowledges that she has read and agreed to the following terms, subject to her statutory rights under the laws of the Kingdom of Saudi Arabia.

1. Scope of the Consultation

  1. The House provides a private 45-minute design consultation with its designer through Google Meet.

  2. The consultation includes discussing the client's design preferences, desired dress, suitable fabrics, design details, and the possibility of commissioning a custom-made dress.

  3. The consultation does not include the delivery of final design sketches, technical drawings, patterns, fabric samples, or design files unless separately agreed in writing.

  4. The consultation does not constitute a dress-making agreement or an obligation by the House to accept or execute any particular design.

  5. Any preliminary prices, production timelines, or recommendations discussed during the consultation are indicative only and are not binding unless confirmed in a separate written agreement.

2. Consultation Fees and Payment

  1. The consultation fee is SAR 230, inclusive of 15% Value Added Tax (VAT).

  2. Payment must be made in advance by bank transfer to the official account specified by the House.

  3. Submission of a booking request or completion of a bank transfer does not constitute final booking confirmation.

  4. All requests are subject to review, payment verification, and appointment availability.

  5. A booking is confirmed only upon express confirmation by the House through an official communication channel.

  6. The client is responsible for verifying the beneficiary and payment details before transferring funds. The House is not responsible for transfers sent to an incorrect account due to client error, except where the error results from incorrect instructions provided by the House.

3. Booking, Cancellation, Rescheduling and Refunds

  1. Each confirmed consultation reserves an exclusive time slot in the designer's schedule, preventing the House from offering that appointment to other clients.

  2. Due to the reserved and time-sensitive nature of the service, confirmed appointments are non-cancellable, non-reschedulable, and the consultation fee is non-refundable at the client's request, to the extent permitted by applicable law.

  3. The client is responsible for attending the consultation at the confirmed date and time.

  4. Late arrival, failure to attend, or failure to join the meeting does not automatically entitle the client to an extension, replacement appointment, or refund, subject to applicable statutory rights.

  5. Once the consultation has been fully provided, the consultation fee is non-refundable except where a refund is required by applicable law.

  6. If the House is unable to provide the consultation for reasons attributable to the House, the client will be offered a mutually agreed alternative appointment or an applicable refund.

  7. Nothing in these terms excludes or restricts any mandatory consumer rights under Saudi Arabian law.

4. Consultation Fee Credit Toward a Dress Order

  1. If the client enters into a custom dress-making agreement with the House, the SAR 230 consultation fee will be credited toward the amount payable for that dress.

  2. The consultation credit remains valid for three (3) months from the date of the consultation.

  3. To qualify for the credit, the client must enter into a dress-making agreement within this three-month period.

  4. Any unused consultation credit expires after the stated period and cannot be redeemed for cash, transferred to another client, or applied more than once.

  5. Payment of the consultation fee does not guarantee acceptance of a dress order or availability of any specific design, fabric, or production date.

  6. The credit will be reflected in the relevant payment and invoicing records in accordance with applicable tax requirements.

5. Attendance and Technical Requirements

  1. Consultations take place at the confirmed date and time according to Saudi Arabia Standard Time (UTC+3).

  2. The client must have a compatible device, a stable internet connection, and access to Google Meet.

  3. Late arrival does not extend the scheduled end time of the consultation unless expressly agreed by the House.

  4. Technical interruptions caused by the client's equipment or internet connection will be assessed according to the circumstances and applicable law.

  5. Where a technical failure attributable to the House materially prevents the service from being delivered, appropriate arrangements will be made to complete or reschedule the consultation or provide any refund required by law.

6. Intellectual Property and Confidentiality

  1. All original designs, sketches, concepts, and creative works belonging to the House remain the intellectual property of their respective rights holders.

  2. Payment of the consultation fee does not transfer ownership of any intellectual property to the client.

  3. The client retains her rights in original materials and designs she provides during the consultation.

  4. Neither party may record, reproduce, publish, or distribute the consultation or its contents without the necessary prior consent of the other party.

  5. The House does not offer exact reproductions of third-party protected designs.

  6. Client information, reference images, and personal data will be handled in accordance with the House's Privacy Policy and applicable data protection laws.

7. Limitation of Liability

  1. The consultation is an advisory service and does not guarantee the acceptance, production, or completion of any dress.

  2. Any execution of a dress design requires a separate agreement specifying the design, price, payment terms, and production conditions.

  3. The House is not responsible for decisions made by the client outside the agreed scope of the consultation, except to the extent liability arises under applicable law.

  4. Nothing in these Terms and Conditions excludes liability that cannot lawfully be excluded.

8. Governing Law and General Provisions

  1. These Terms and Conditions are governed by the laws and regulations of the Kingdom of Saudi Arabia.

  2. Any disputes shall be referred to the competent authorities or courts in accordance with applicable law.

  3. These terms supplement the general Terms of Service and Privacy Policy published on the House's official website.

  4. If any provision is found unenforceable, the remaining provisions shall continue to apply to the extent legally permissible.

  5. The version of the terms accepted by the client at the time of booking shall apply, subject to mandatory applicable law.
